All states have laws called "lemon laws." These laws are to help protect consumers against defects in the cars that they have purchased. Each state specifies how its lemon laws should be interpreted. New York actually has 2 New York State Lemon Laws.

One protects consumers against faulty or defective new cars. There is also law to protect buyers who purchase a used car. This article will focus on the new car New York State Lemon Laws.



The New York State Lemon Law for new vehicles simply states that your automobile is protected against any defects for the first 2 years or 18,000 miles, whichever elapses first. Your car is still covered for those first 2 years or 18,000 miles even without an extended warranty. Your vehicle must be both purchased and registered in the state of New York in order to be protected by the New York State Lemon Law.

Once you detect the problem or defect, you must first contact the manufacturer right away. The state lemon law requires the defect to be fixed by the manufacturer without the consumer incurring any out-of-pocket costs. If you have attempted unsuccessfully to fix the problem more than four times, you are protected under the New York State Lemon Law.

If your vehicle undergoes repair for more than 30 days to fix a single problem, that situation is also protected by the New York State Lemon Law.

Additionally, any consumer refused repair within 20 days after notifying the manufacturer is protected by the New York State Lemon Law.

In simplest terms, the New York State Lemon Law states that the automobile purchaser is entitled to a comparable replacement vehicle, or a full refund, if any of these conditions applies.



The New York State Lemon Law does not cover any damage caused by the consumer. The consumer is also not protected if the recurring problem does not in any way decrease the value of the car.

The best way to stay protected is to know your rights as a consumer. The New York State Lemon Laws were enacted to protect car consumers against defects in car parts and vehicles. An agreement made to alter the New York State Lemon Law will not be legally recognized in a court of law.
